Reincorporation

Within the framework of the Final Agreement for the Termination of the Conflict and the Construction of a Stable and Lasting Peace (Peace Agreement), the National Government and the FARC - EP, agreed on point 3.2., what is related to the reincorporation of the FARC - EP to civilian life in the economic, social and political aspects according to their interests and in particular point 3.2.2 what is concerned to the economic and social Reincorporation. 

In order to implement what was agreed on this matter, it was necessary to established what was agreed in the Final Agreement normatively and in view of the foregoing, Decree No. 899 of May 29, 2017 was issued: "By which measures and instruments are established to the collective and individual economic and social reintegration by the FARC - EP members in accordance with the Final Agreement…".


Reincorporation Line


National Council for Reincorporation 

The Final Agreement for the Termination of the Conflict and the Construction of a Stable and Lasting Peace, in point 3 relative to the End of the Conflict, establishes that the reincorporation of the FARC - EP, shall be defined by the NATIONAL COUNCIL FOR REINCORPORATION, also known by its acronym CNR (Consejo Nacional de Reincorporación – for its acronym in Spanish). 

General Information: The CNR was created as an instance through Decree 2027 of 2016, on December 7 2016. 

Composition: It is composed by:  

  • Two (02) members of the National Government.
    • José Emilio Archila Peñalosa. High Counselor for Stabilization.
    • Andrés Stapper. ARN General Director
  • Two (02) FARC - EP members:
    • Pastor Alape.
    • Luis Ernesto Medina.
       
  • The CNR may invite government agencies, social organizations and international development agencies to carry out its functions.
     
  • Territorial Councils of Reincorporation. 

Powers:

  1. Define the activities,

  2. Set the schedule and

  3. Carry out the follow - up to the reincorporation process of the FARC - EP to legal life in the economic, social and political aspects, according to its interests.

Functions: 

  • Define the activities, establish the schedule and carry out the follow - up to the reincorporation process of the FARC - EP members;

  • Provide guidelines to ensure the articulation with the competent entities, on the work that will be carried out by the social and solidarity economy organization, consisting of the FARC - EP members in reincorporation process, called Social Economies of the Common (ECOMUN – Economías Sociales del Común – for its acronym in Spanish), covered by point 3.2.2.1. of the Final Agreement;

  • Define the terms, conditions, and functions of the Territorial Councils for Reincorporation

  • Define the content, implementation form, custody and good use of the socio - economic census information for the FARC - EP members in reintegration process;

  • Verify the viability of the collective and services productive projects of the  economic and social reintegration process of the FARC - EP members who decide to participate in collective projects through ECOMUN or those who individually wish to undertake productive or housing projects;

  • Define the terms and duration of the social Reincorporation plans or programs identified based on the results of the Socio - Economic Census, which is discussed in point 3.2.2.7., "Pedagogy of Peace" of the Final Agreement;

  • Arrange with the departmental assemblies and governors the Pedagogy of Peace works to be carried out by the spokespersons designated by FARC - EP in reincorporation process, in accordance with the point 3.2.2.7. "Pedagogy of peace" of the Final Agreement;

  • Discuss the special measures for the care and protection of boys, girls  and adolescents who have left or leave the FARC – EP camps, from the beginning of the peace talks until the completion of the surrender of arms process;

  • Prepare the guidelines of the Special Comprehensive Program for the restitution of the rights of boys, girls and adolescents leaving the FARC - EP, on the basis of the proposal submitted by the bureau technique created by Joint Communiqué No. 70. The Program shall be adopted by the competent authorities;

  • Perform a follow-up to the reincorporation program into civilian life of the FARC - EP members and Special Comprehensive Program for the restitution of the rights of boys, girls and adolescents leaving the FARC - EP, in coordination with the competent entities of the State;

  • Receive the periodic reports of ECOMUN related to the execution of resources;

  • Define the preparatory activities for the reincorporation which will take place in the Transitional Village Areas for Reincorporation and Transitional Points for Normalization, to be executed by the competent entities;

  • Carry out accountability on its work to the Commission for Monitoring, Boosting and Verification to the Implementation of the Final Agreement.



Technical Reincorporation Unit 


This is an internal work group governed by ARN's General Directorate, with adequate and sufficient resources to develop the reincorporation program of the members of the FARC-EP into civil life, both economically and socially, according to their interests, and strictly subject to the terms and conditions defined by the National Reincorporation Council (CNR), as established in the Final Agreement for the Termination of the Conflict and the Construction of a Stable and Lasting Peace signed on November 24, 2016, and in the constitutional and legal regulations adopted for its implementation.

The Unit was created by Decree-Law 897 of 2017 (article 4) "... At the Reincorporation and Normalization Agency -ARN, a Technical Unit for the Reincorporation and Normalization of the FARC-EP will be organized, as an internal group of work assigned to the Directorate General of ARN, with adequate and sufficient resources to develop the program of reincorporation of the members of the FARC-EP into civil life, both economically and socially, and according to their interests, strictly subject to the terms and conditions defined by the National Reincorporation Council (CNR) ... "

Likewise, the Unit was created within the entity through Resolution 2181 of 2017, dated October 4th, 2017 "by which an internal work group is created in the internal structure of the Reincorporation and Normalization Agency and the functions are assigned. "
